Making Sense of the new Home Inspection Licensing Laws!!!

The State Bill 2234 enacted June 27, 2007 requires home inspectors to be licensed by the state of Florida by July 1st, 2010. However, the state entity that controls licensing for home inspectors, DBPR (Department of Business and Professional Regulations) has proposed legislation that delays enforcement of the licensing to July 1st, 2011. As an employee of DBPR stated to me, on the phone, the details of the licensing are “still being pounded out”.

This means technically a home inspector must be licensed to do home inspections on or after July 1st 2010. But Enforcement proposed under Senate Bill 1330 and House Bill 713 delay unlicensed enforcement until July 1, 2011. This gives all home inspectors time to comply with the new licensing law. What is important to note is that there will be NO LICENSESED home inspectors on July 1st, 2010.

Two chapters of the new law that are important to note are the requirements of insurance and requirements of disclosures. Chapter 468.8322 states: “A home inspector shall maintain a commercial general liability insurance policy in an amount of not less than $300,000”. Safeguard Inspectors LLC has always maintained commercial general liability coverage of $1,000,000.00, as well as Errors and Omissions coverage of an additional $1,000,000.00. Chapter 468.821 States: “Prior to contracting for or commencing a home inspection, a home inspector shall provide to the consumer a copy of his or her license to practice home inspection services in this state and a written disclosure that contains the scope and any exclusions of the home inspection.” Safeguard Inspectors LLC has always provided a disclosure that contains any exclusion of the home inspections.

Prior to these new licensing laws, there were no laws in place to be a home inspector. This allowed anyone with a flashlight, camera, and a business card to call them self a home inspector. Now with the new law you are going to be sure you are dealing with a licensed professional.
